By accessing and using CircLely ("the App"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Eligibility

CircLely is intended for users who are 18 years of age or older. By using our App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

3. Description of Service

CircLely is a personal life management application that provides the following features:

• Mood tracking and emotional pattern analysis
• Task management and productivity tools
• Personal diary and note-taking capabilities
• Photo organization and memory management

4. User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account information
• All activities that occur under your account
• Using the App in compliance with all applicable laws and regulations
• Ensuring your device meets the minimum requirements for running the App
• Backing up your local data as needed

5. Prohibited Uses

You may not use CircLely for any unlawful purposes or to conduct any unlawful activity, including but not limited to:

• Violating any applicable laws or regulations
• Attempting to reverse engineer or modify the App
• Using the App to store or transmit malicious code
• Interfering with the operation of the App or our servers
• Attempting to gain unauthorized access to other users' data

6. In-App Purchases and Coins

CircLely offers in-app purchases of virtual coins for enhanced features:

Coin Purchases:

• Coins are virtual currency used within the App for premium features
• All coin purchases are final and non-refundable unless required by law
• Coins have no real-world value and cannot be exchanged for real currency
• Your coin balance is tied to your account and stored securely

Payment Terms:

• Payments are processed through the Apple App Store
• All transactions are subject to Apple's terms and conditions
• Prices are subject to change without notice
• Promotional offers may be time-limited and subject to specific terms

7. Data and Privacy

Your privacy is important to us. Our data handling practices are governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points include:

• Most of your personal data is stored locally on your device
• We only collect minimal data necessary for account management and coin transactions
• Your personal content (diary entries, moods, tasks, photos) remains private and local

8. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of CircLely and its licensors. The App is protected by copyright, trademark, and other laws.

9. Disclaimers and Limitations

Service Availability:

• We do not guarantee that the App will be available 24/7
• We may suspend or terminate the service for maintenance or other reasons
• We are not responsible for data loss due to device issues or user actions

Limitation of Liability:

To the maximum extent permitted by law, CircLely shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

10. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes through the App or other appropriate means. Continued use of the App after such modifications constitutes acceptance of the updated terms.

11. Termination

You may stop using the App at any time. We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms.

12. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction where CircLely operates, without regard to conflict of law provisions.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and CircLely regarding the use of the App.
